European Deposit Disputes Aren't Won by Being Right — They're Won by Having Records

Deposit rules across Europe have almost nothing in common. Some countries require the money to sit in a protected or escrow arrangement. Some set strict return deadlines. Some cap the amount at a specific multiple of rent. A few require interest. The details differ enough that advice from one country is often actively wrong in the next, and you'll want to confirm exactly what applies where your property is.

What doesn't differ is how disputes get resolved. Whoever is adjudicating — a scheme, a tribunal, a court, a mediator — is asking the same question everywhere: what evidence do you have?

Being in the right is not the same as prevailing

This is the part landlords find genuinely unfair, and it's worth internalising early. You can be entirely correct that a tenant damaged something, and still lose the deduction, because correctness isn't what's being assessed. What's being assessed is proof.

A landlord who says the wall was undamaged at move-in is making an assertion. A landlord with a dated photograph of that wall is making an argument. Only one of those survives contact with a dispute process.

The record that does the work

Three things, made at the start of the tenancy rather than the end:

Dated photographs of every room, taken before the tenant's belongings arrive, including floors, walls, appliance interiors and anything already imperfect.

A written condition report, signed by both parties, that references those photographs.

An inventory if the property is furnished, itemised, with condition noted per item rather than a single line saying "furniture: good".

None of this takes more than an hour. All of it is impossible to create retroactively, which is precisely why it's decisive.

Itemise, always

When you do withhold, itemise: what the deduction is for, what it cost, and which documented difference it corresponds to. A single unexplained figure invites a challenge. A list where each line traces back to evidence usually ends the conversation before it becomes a dispute.

And whatever deadline applies to you for returning the balance and providing that breakdown — find it, and treat it as immovable. Missing it can cost you the right to deduct at all, regardless of how good your evidence was.

How LandlordViva helps

LandlordViva keeps tenant records, lease terms and payment history tied to the unit, and generates PDF statements and tenant history from them. When a deposit question surfaces at the end of a tenancy, the paperwork is retrievable in one place rather than reconstructed from a camera roll and three email threads.

Deposits are where good landlords most often lose money they were entitled to keep. Not because they were wrong — because an hour at move-in got skipped.
